General Terms and Conditions

GENERAL TERMS AND CONDITIONS of the Private Limited Company Ära24 Holding B.V., established in Amsterdam, The Netherlands and registered with the Chamber of Commerce under number 66641233 (KvK)
Our website usage and any orders made through it are subject to these General Terms and Conditions. These Terms and Conditions are important for you as a customer, thus we kindly request you to take a moment and read them attentively. We also suggest saving or printing these conditions for future reference, if needed.

Article 1 Definitions
1.1. Connectytoys: The aforementioned Ära24 Holding BV
1.2. Website: the ConnectyToys website(s), available via https://www.connectytoys.com.
1.3. Customer: the natural person not acting in a professional or commercial capacity, who enters into an Agreement with ConnectyToys and/or who has registered on the website.
1.4. Agreement: any agreement or contract between ConnectyToys and the Customer, of which these General Terms and Conditions are an integral part.
1.5. General Terms and Conditions: these General Terms and Conditions.

Applicability of the General Terms and Conditions
These General Terms and Conditions apply to all offers and/or tenders by ConnectyToys as well as to all Agreements and agreements to be entered into by ConnectyToys and the ensuing activities, including the supply of goods and services, with the explicit exclusion of any general terms and conditions of the Customer.
Derogations from these General Terms and Conditions must have been expressly agreed upon in writing. Any derogation will only apply to the offers concerned and/or Agreements in which reference to such derogation was made.
Should ConnectyToys not always demand strict observance of these General Terms and Conditions, this does not imply that these General Terms and Conditions do not apply and/or that ConnectyToys will lose the right to demand strict observance of these General Terms and Conditions in future cases, whether similar or not.
The rescission and/or nullity of any stipulation of these General Terms and Conditions (irrespective of the reason for such rescission or nullification) does not affect the other stipulations. The conflicting, legally invalid, stipulation will be considered to have been replaced by a stipulation in which the intentions and purpose of the original stipulation are done justice.
ConnectyToys may not be held liable if the Customer has used a product in a manner other than that recommended, prescribed, or otherwise intended.

Prices, Price changes and information
Unless stated otherwise on the Website, all prices for materials listed on the Website or published in another manner by ConnectyToys are including VAT and other levies required by law.
ConnectyToys is entitled to charge extra costs, which were not agreed upon expressly in the Agreement, separately to the Customer, if incurring these costs is necessary for the execution of the Agreement.When appropriate, the Customer will be informed of such costs in writing as soon as possible. ConnectyToys is furthermore entitled to raise the prices and tariffs agreed upon, amongst others in case of interim price increases and/or surcharges on prices of goods, costs of materials, semi-finished products or services necessary for the execution of the Agreement, shipping costs, wages or social contributions, decrease in value of the currencies agreed upon and all other government measures having the effect of increasing prices as a result of which the cost price increases. In any such event, the Customer will be informed thereof in writing as soon as reasonably possible.
Free order shipment from €99 . These costs are also posted on the Website. These costs will also be clearly indicated during the order process. The contents of the Website have been compiled with the greatest possible care. However, ConnectyToys cannot guarantee that all information provided on the Website are accurate and complete at all times. All prices and other information provided on the Website and in other ConnectyToys communications materials are therefore subject to reservations for obvious programming, typing, or spelling errors.

Payment
The Customer must make payments to ConnectyToys in accordance with the payment methods indicated during the order procedure on the Website.
ConnectyToys is free to choose which payment methods are offered, and is authorised to change the payment options at any time.
Any payment by the Customer must be made without any (claimed) right of discount, suspension, deduction and/or set off.

Free gifts
The free gift cannot be substituted for any other item, cash or credit.
The free gift offer may not be used in conjunction with any other offer or promotion that we run on connectytoys.com, unless otherwise stated.
Free gift offer or promotion is valid within the dates or while supplies last.
If you return qualifying item(s), please be sure to include the free gift with the return. If you would like to keep the free gift but not the qualifying item(s), we will deduct the full price of the gift from your refund.
Participants who make purchases outside the Promotion Period will not receive the Gift with their purchase.
ConnectyToys reserves the right to limit, delete or change any of the rules, terms and conditions at its sole discretion, with or without notice. ConnectyToys’ decision will be final.

Agreement into effect
The Agreement shall be realised at the moment the Customer accepts the offer by ConnectyToys.
If the Customer has accepted the offer electronically, then ConnectyToys shall immediately confirm the acceptance of the offer via electronic means as well. The Customer retains the option of dissolving the Agreement until the acceptance of the offer has been confirmed.
In the event that the Customer has provided incorrect information when entering into the Agreement, then ConnectyToys retains the right to delay the fulfillment of its obligations until the correct information has been received.
ConnectyToys may use all legal means to determine if the Customer has fulfilled his/her payment obligations or to obtain all facts and factors necessary to enter into the Agreement in a responsible manner. If, based on this investigation, ConnectyToys has reasonable grounds not to enter into the Agreement, then ConnectyToys is authorized to refuse an order or request or to impose special conditions, such as prepayment, on the implementation of the agreement.

Retention of title and right of pledge ConnectyToys will remain the owner of all goods delivered by it until the Customer has fulfilled all its obligations according to the Agreement, particularly payment obligations, including interest and costs.

Shiping and Delivery
Once ConnectyToys has received the order, ConnectyToys shall send the products to the address provided by the Customer as quickly as possible. It usually takes 3-5 working days to receive your order.
If you are not home at the time of delivery, a notice will be posted that a delivery attempt was made and it will offer a variety of ways for you to obtain your order. Or the package will be left at someone's door.
If a package is refused upon delivery and returned to our facility without an RMA number, the product value will be refunded upon receipt, less the original shipping fee as well as the shipping fee charged by your carrier to return the package to our facility.
International orders may be subject to additional customs fees and duties. Unfortunately, we are not able to include these additional costs as a part of the total amount, as each country has its own duty and customs regulations.
ConnectyToys advises the Customer to inspect the products delivered, and to report any defects within a reasonable time frame, preferably in writing.
Once the products have been delivered to the address provided, then the Customer shall bear any risk related to the products. The Parties may agree to transfer the risk to the Client at an earlier moment. If the Customer chooses to pick up the products, then the risk shall be transferred along with the products.
All delivery times given by ConnectyToys are approximate delivery times and can never be considered to be strict deadlines.
Any delivery time will only commence when agreement has been reached between parties on all commercial and technical details, all necessary data are in the possession of ConnectyToys, the payments (in instalments) have been received and, furthermore, all other conditions for the execution of the agreement have been met.
The mere expiration of a delivery time does not constitute a default on the part of ConnectyToys.
ConnectyToys is not held to deliver goods in instalments, however, ConnectyToys does have the right to execute the Agreement in instalments. In case of delivery in instalments, each delivery is to be considered to be a separate transaction.
In the execution of the Agreement, the Customer is held by ConnectyToys to do everything in reason necessary or desirable to enable a timely delivery by ConnectyToys.
Should the Customer not meet his obligations ensuing from the Agreement, ConnectyToys will be authorised and entitled to postpone and suspend the execution of the Agreement forthwith, or to completely or partially dissolve, annul or adapt the Agreement. ConnectyToys can never be held to any compensation of damages to the Customer as a result of such a suspension, dissolution annulment or adaptation. The Customer is, however, held to compensation of any damages ensuing from the delay caused by the suspension, also in respect of third parties and fully indemnifies ConnectyToys in this matter.
The Customer shall be obliged to follow any instructions on the use of the products provided by ConnectyToys.
The Customer shall in no event be entitled to modify any product in any manner. Modifications shall include any addition to the product and/or affixation of any sign to identify the Customer.
The manner of transport, shipping, packaging and suchlike will at all times be determined by ConnectyToys.
Delivery of the goods by ConnectyToys will take place at the address designated by the Customer.

Waranty
If the product delivered does not comply with the Agreement, then the Customer may inform ConnectyToys of such within a reasonable period after discovery of the defect.
If ConnectyToys judges the complaint to be justified, the relevant products will be repaired, replaced, or refunded after consultation with the Customer. The maximum compensation shall be equal to the price paid by the Customer for the product, in accordance with the Article pertaining to liability

Returns
All items that are unopened and unused can be returned for a partial refund. We will deduct shipping costs and pick and pack costs; roughly around USD $22 - USD $25. We will NOT accept opened or used items for return.
The Customer shall treat the product and packaging with care.
The Customer is responsible for the costs of return shipments.

Cancelation
If your order has NOT been shipped out, and you want to cancel it, please send an email to us within 4 hours of making the order. We will cancel it as soon as possible and issue a FULL refund. If you do not cancel the order within the first 4 hours, we cannot guarantee a full refund of your order.

Complaint procedure
If the Customer has a complaint about a product (in accordance with the Article pertaining to warranty and conformity) and/or another aspect of the services provided by ConnectyToys, then he/she can submit a complaint to ConnectyToys via e-mail or telephone.
ConnectyToys shall reply to the Customer’s complaint as quickly as possible, at least within five working days. If it is not possible to provide a concrete or definitive answer, then within two days of the receipt of the complaint ConnectyToys shall confirm such receipt and provide an indication of the time frame within which a concrete or definitive answer to the Customer’s complaint can be expected

Closing provisions
The Agreement, these Terms and Conditions, and all other agreements arising from the Agreement, are subject to Dutch law, unless prescribed otherwise by force of law.
Inasmuch as no other law supersedes the above, all disputes that may arise as a result of the Agreement shall be submitted to the competent Dutch court of Den Bosch in the Netherlands.
In the event that a provision in these General Terms and Conditions are found to be invalid, such shall not prejudice the validity of the General Terms and Conditions as a whole. In such an event, the parties shall agree to a new replacement provision or provisions that will abide with the intention of the original provision to the extent that such is legally possible.
